[aaykarbhavan] Murder of CA:Letter from Saheed CA Anand's Father demanding support from ICAI on murder of his beloved son [2 Attachments]

Ref: Murder of my son CA Anand Kumar at Dehing Officer’s Colony of North Eastern Coalfields, Margherita, Dist: Tinsukia, Assam
Sub: ICAI’s cooperation for Neutral & independent probe of the suspected murder of Anand Kumar
 
OUR EXPECTATION FROM ICAI ON MURDER OF SON CA ANAND KUMAR: 
1)      CBI INVESTIGATION:  
a) We expect from ICAI to write to President, PM, Home Minister, MCA, CM & Governor of Assam for investigation by CBI.
b)We also like to go with representative of ICAI to meet  President, PM, Home Minister, MCA, CM & Governor of Assam or any other Minister/officers for such demand.
2)      JOINT CONFERENCE:  To take help of media, we want a joint conference with ICAI to show the unity of CA Fraternity & to show the concern of ICAI on matter of murder of a member & to build a social awareness that ICAI is with members & their family.
3)      FINANCIAL ASSISTANCE: Anand was the eldest son & only source of earning for my family. I am financially & physically weak to support my family. Anand was financially helping me, my younger son (who is student) & other family members.
 
With reference to the above, I also want to submit as under:
1.      I am Kamlesh Kumar Agarwal, resident of Main Road, Dumka – 814101, Distt. Dumka (Jharkhand). I am the father of Anand Kumar, the deceased.
2.      Late Anand Kumar was a brilliant student, gentle in behavior, well mannered, soft spoken and honest person having no bad habits. All of his qualities are well acknowledged by all known to him including at Margherita. He was about 26 years old only and was unmarried.
3.      He joined Coal India Limited in October 2013 and was posted at North Eastern Coalfields, Margherita, Dist: Tinsukia, Assam as Management Trainee (Finance) and his employee number (EIS No.) is 90321415.
4.      He was residing at Dehing Officer’s Colony of North Eastern Coalfields, Margherita and performing his duty honestly and happily.
5.      On 4th April 2014, all of a sudden at about 9.30 a.m., I got a message of the employer company through one of my relative that Anand’s condition is serious and is hospitalized at Margherita. It was suggested by the Employer Company to send 2 – 3 near & dear of Anand Kumar immediately to Margherita to take care of him.
6.       My nephew, Vikash Agarwal, along with my younger son, Aman Agarwal, and one close relative, all residing in Kolkata, proceeded for Dibrugarh by flight for which air tickets were arranged by the employer company of my son and to move further for Margherita by car which was also arranged for by the employer Company at the Dibrugarh airport.
7.      After arrival at Dibrugarh Airport at 02.15 pm on 04/04/2014, my relatives were informed to move for Tinsukia instead of Margherita and they were informed that Anand Kumar has passed away and his dead body has been brought to Tinsukia Hospital for Post Mortem. So Employer Company’s representative took my relatives to Tinsukia.
8.      When my relatives reached L.G.B. Civil Hospital, Tinsukia at 3.30 that evening, they were surprised to see that dead body of my son was already under the Post Mortem process and after some time my relatives were handed over the death certificate having Post Mortem No. 169/14 which was signed by the doctor conducting the Post Mortem at 03.45 pm stating that time since death is 12-24 hours and cause of death was written as pending.
9.      During discussion it was stated by employer Company official that Anand’s flat partner, Amit Chaudhary, knocked Anand’s door at 7.45 am on 04/04/2014 but there was no response from the room. Amit Chaudhary, then called other persons, and then the door of my son’s room was broken and they found Anand fallen on the floor. Doctor was called up, who, after examining, declared him dead at 08.15 am according to his Death Certificate No. NEC / CMO / 19 / NED dated 04.04.2014.
10.  Representatives of the employer Company offered my relatives to visit Margherita at about 4.15 evening. But, at the same time my relatives were told the programme to move for Dibrugarh for packing of dead body as per airline norms and after that visit to Margherita from Dibrugarh having driving time of 2.30 hrs. Company took my relatives to Dibrugarh along with dead body but, the whole process of packing and travelling took about 4 to 5 hours and it became 09.30 pm.
11.  After completing the packing process my relatives had no courage to move further for Margherita having fear for their own security as they foresaw some conspiracy in the death of Anand Kumar. The place was quite new for my relatives and the situation and circumstances had created fear in the minds of my relatives.
12.  Company made arrangement for stay of my relatives in Purvanchal Pratisthan, a guest house at Dibrugarh, for the night, where my relatives spent sleepless night full of fear.
13.  On the morning of 5th April 2014 necessary formalities were made to carry dead body up to Kolkata by air as well as up to Dumka by road and all arrangements were made by the Company where my son was serving.
14.  The dead body was brought to my home at Dumka at 10.00 pm of 5th April 2014. When, as per holy customs, body wraps were removed and then only it was noticed by many of my relatives that there was a cut mark (approx. 4 inch long) on right shoulder below the neck which cannot be the part of the Post Mortem.
Now, I feel that there are many reasons to suspect that my son has been murdered and someone from the Employer Company is trying to create a scene which would save the actual culprit who is involved in my son’s suspected murder. I have the following points to be taken into consideration as all these circumstances clearly indicate that some conspiracy is there in the suspected murder of Anand Kumar:-
1.      Death of my son is said to have taken place early on 04/04/2014. Authorities of the Company had full knowledge that relatives of the deceased have already moved from Kolkata and in fact, all my relatives reached L.G.B. Civil Hospital, Tinsukia at 3:30 pm but it is surprising that the Company authorities instead of waiting for my relatives had sent the dead body for Post Mortem. The return ticket for flight from Dibrugarh to Kolkata was also booked and arranged by the authorities of the employer Company for flight at next afternoon i.e. 12:15 pm of 5th April 2014. It is a matter of suspicion that having a lot of time for return flight, why the Company was in a hurry for Post Mortem and they even not waited for relatives of the deceased to show the dead body & taking consent for Post Mortem. This is also important that a cut mark was found on the dead body which also creates a strong cause to suspect that the cause of death is not natural.
2.      In the whole process, the role of his flat partner, Amit Chowdhary, is also under suspicion. Living in one flat in two separate rooms having common lobby and kitchen, how is it possible that he would not hear or feel any abnormal activity in the night. As per his statement, till 9.00 pm of 3rdApril 2014 both of them were together. They watched cricket match on TV, had their dinner together and after that they went for sleep in their respective rooms. He further stated that in the dinner there were separate dishes that night for both of them prepared by cook in their common kitchen.
3.      As per bank statement of brother of the deceased, Anand Kumar, named Aman Kumar, has received Rs.5000/- from the deceased, Anand Kumar, by online net banking transfer in his bank account at 11:54:26 pm. It clearly indicates that till 12.00 midnight my son, Anand Kumar, was physically & mentally fit with sound and stable mind and nothing untoward had happened by then.
4.      As per Amit’s statement, he knocked Anand’s room at 07.45 am. It means death of my son Anand Kumar occurred between 12.00 mid night of 3rd April 2014 to 07.45 am of 4th April 2014. As per death certificate having Post Mortem No. 169/14 which was signed by doctor conducting the Post Mortem at 03.45 pm stating time since death is 12-24 hours. According to this, death time is prior to 3.45 am of 4th April 2014. It means actual death time is in between 12.00 mid night of 3rd April 2014 to 3.45 am of 4th April 2014.
5.      Now it has to be investigated that who came in the room of my son Anand Kumar during this time and what happened in that room. It is also to be suspect that how is it possible that in the silence of mid night his flat partner Amit Chaudhary available in adjoining room could not hear any sound, noise or saw abnormal activities. I feel that this Amit Chaudhary knows all happenings of that black night. He is either an eye witness of suspected murder or he is also involved in whole activities. I strongly demand to book this person for interrogation to know the truth. It is significant that soon after the occurrence, said Amit Chaudhary has been transferred from Assam to Jharkhand.
6.      The cut mark of approx. 4 inch long on right shoulder below the neck noticed by my relatives at the time of funeral should also be investigated why it was present on the body while it cannot be a part of Post Mortem. It clearly indicates that Anand Kumar had been attacked with some sharp weapon by somebody and ultimately he died on the spot or somebody has poisoned him.
7.      It is necessary to inform that my son had come to his native place in March 2014, he had shared with one of the relatives that he had noticed some unfair and irregularities in financial matters of his Company and he may have to face any type of pressure to sign and acknowledge such wrong dealings and he was advised not to be a part of such activities and in case of pressure, he was advised to come back to home. There are chances that my son must have encountered such pressure and on refusal to signing such paper he has been killed.
Sir, I am financially weak and due to fear, none of my family members are ready to move for Assam and contact you personally, but I am sure that my son has been murdered under a criminal conspiracy which shall be revealed if a proper enquiry in this regard is made. Presently, at the instance of the company, Margherita P.S. UD Case No. 08/2014 has been registered with a view to change the line of investigation and to hush up the entire case as well as to avoid financial liabilities of the employer company.
Under such circumstances, it is requested to look into the matter personally and you may be kind enough to take necessary steps so that proper investigation in this regard can be made and the employer Company authority may be restrained from influencing the investigation.
