Dear Members,
-- Today MCA has issued two circulars clarifying that:
1. The subsidiary incorporated in India under the CA, 1956/2013, of a Company incorporated outside India may be public/private as the case may be. Means no deeming provision similar to section 4(7) of CA, 1956.
2. Shares held in other Company in fiduciary capacity shall not be counted for determining associate company relation.
