Long back it was a practice of using green ink by auditors. The reverse tic of the auditors was used to be in green ink or pencil. The auditors also used to sign in green ink with the seal in red colour.

In my opinion it will be good if you engage the foreign national as a consultant since apart from salary there are several other payments which become necessary when the employer-employee relationship is established. it may include EPF liability to enroll and pay regular contributions, although it will be difficult to get away from EPF coverage if the salary is in the ambit of EPF liability.
Moreover with my practical experience, all payments made will be liable to TDS in the absence of PAN it is 20% or in case DTAA suggests for a higher rate then the higher rate.
Opening a bank account will also be a challenge in this case.

One of our clients wishes to engage a foreign national (Turkish) either as a salaried employee or as a consultant for his business in India. The person to be engaged is a non resident. He will be visiting India seldom and his stay will not exceed 180 days. He does not have a PAN number or bank account in India. The payments will be made overseas by remittance. Ultimately, the foreign national will open a bank account in India and the payments will be made locally.
The queries are as under :
1. Will it be beneficial to engage him as a consultant or as a salaried person (tax wise).2. Is there any permission required from RBI for a foreign national to take up employment in India or work as a consultant (proprietorship firm).3. Will it make any difference if the payments are remitted abroad or made in India.4. When he takes PAN number and opens bank account in India, is there any restriction in remitting payment overseas after payment of taxes in India. He does not any income abroad and is not filing his returns anywhere.
