As far as I know ordinarily in Petition itself there should be one paragraph in petition itself ,like CONDONATION OF DELAY .  You should explain the fact by narrating the circumstances , ans fact by which caused a delay fully and frankly. There should be no hid of the material facts in any case.
If you give me full details I may give you draft for the same.

File form 21 attaching the Regional Director's Order.  Before that pay the penalty through Misc payments. Once the form 24 AAA and form 21 is approved , then form 8 will also be approved and the registration of charges certificate will be sent through mail by MCA.
