[aaykarbhavan] Re: {Amresh's CA's} Fw: Company Incorporation problem



This has to be brought to the authority . I am sending this e mail to Ministry of Corporate Affairs offices . E mail ids are given/ allotted  by MC A . But it will bounced back with return memo Data of Disc is full!!!!!!!!!!!!!!!!!!
The culture of MCA / ROC is well known to all. What they stands for Compliance of Law , Supervisors of law and many thing. It is a cash counter only. I have reported a Case of illegal payment of dividend , dividend paid out of capital which has never happened in all over the world , not reported as a case Law, but not taking any action. SATYAM fraud came out in 3 years but this has not came out for last 18 years.
Recently one New Practicing  CA was prosecuted wrongly !!! He gone just like  mad !!!

The situation is worse with ROC-Kolkata, neither they pick up phone calls, nor do they respond to your e-mails.

Earlier, I had to lodge a complaint with the Ministry of Corporate Affairs, and then when I went to meet the Officer, he was putting all blames on me for rejection.

Its really embarassing and I really dont know where to go, at least if they give us an unambiguous reply and point out all defects and problems at once there would be no problem, but, you correct one mistake and re-submit and then they point out another.

Now they are looking for trade marks and google search.Not only this the alphabet have been rejected that it is a short form of  a company already incorprated.ROC kanpur working is the worst. Dear Mr. Jain,
 
Try changing the spelling of SONARPUR or alternately you may join both the words.
 
As far as the existence of the other company is concerned, the ROC may instruct you to change the name in case of any complaint by the trade mark owner. The practice of linking the ROC names with the Trade Marks Website has recently started thereby explaining the approval of your other company. One other reason might be the difference of Class under which the existing registration is.
 
In other words, you may have the registration of these words in a class which is separate from the class of existing registration.
 
Hope this will solve your problem.

Dear Professional Colleagues,

I had filed Form 1A for Incorporation of a Private Limited Company with the name starting with SONARPUR SURJYAKIRAN........, it is sent for re-submission with the remarks SONARPUR is a TM.

Please clarify what does this mean and what sort of correction is required ASAP. Calling at MCA 21 Call Center, they said that SONARPUR is a Trade Mark. and hence you will have to change the Name, but, we already have a Public Limited Company registered with the Name SONARPUR SURJYAKIRAN FINANCIAL LIMITED with the same Promoters and Directors which was incorporated in March 2012, so, kindly specify the remedy as we want this name, no such query was raised then.

Then when I search the Trade Mark website I found one such trade mark which existed since 2005 in Class 30, my only question is how did ROC approve the name of the Limited Company of  my Clients just 6 months ago and now they are not providing me with the said name.

The ROC Kolkata never responds to mails and the MCA Call Center keeps saying to contact ROC Officials. I have tried to call on ROC numbers, but, they still never pick up the Phone, I am in a Dilemma....on how to handle this situation. If I join the words SONARPURSURJYAKIRAN whether the same problem will exist.
