[aaykarbhavan] SERVICETAX QUERY

Dear members,

Following are the facts:
1. an office premise is owned by 2 persons in equal shares.
2. they have given said office on rent to one party, getting rent
exceeding rs.10 lacs p.a.
3. they are taking rent in equal shares after individual tax
deduction at source under income tax.

I would like learned members to answer the followings queries:

1. are both co-owners are liable to service tax jointly ?
2. are both co-owners are liable to service tax individually and not
liable to pay ser tax if individual rent do not exceed Rs.10 lac
p.a.?
3. in case they both are liable jointly, in what capacity ser tax
reg. no should be taken?
4. how will they pay ser tax to the govt., when they are getting
separate chqs for rent from party ?
5. will they pay ser tax jointly and file one ser tax return ?
6. what will be accounting entries ?

I request learned members to please guide in the matter.
