I fully endorse the views of Mr. Dipak Shah, as I am one of the victim, suffering a loss of Rs.1,51,065/= due to the malfunctioning of mca website.
For one of my client I filed Form5, vide SRN B66280355 on 22.01.2013 paying a fees of Rs. 1,51,065/=
The Form 5 was returned for re-submission for proper authentication of the attached documents. After proper authentication of the documents, when I tried to resubmit the Form 5, from the last week of Jan. 2013 to Second week of Feb 2013, despite, repeated logging, the website was responding as "Too many users and revisit later".
However, on the 8th Feb. website opened for a brief time and when I could not file the form, I filed a complaint with the Complaint Centre, for which I was given the Ticket No. 1008867 Dt. 08.02.2013. So far I have not received any reply for the above complaint registered.
After many attempts, when I logged in the website on the 12th Feb. 2013, the website instructed to do the prescrutiny before uploading. Accordingly, when I prescrutinised the form, I got the error message that "There are pending Form 5 in respect of the Company. Please file this Form 5 after approval of the pending Form 5".
General Circular No. 03/2013 - Relaxation of additional fees and extension of last date in filing of various forms with the Ministry of Corporate Affairs-[1] MCA relaxes last date for filing /waives additional fees on e-forms which could not be filed due to technical issues in MCA-21 system post 17.01.2013
So, after a few days again when I tried in the mca website, the same problem repeated.
on 25.02.2013, I visited the front office of the ROC - Coimbatore, and took the assistance of the help desk at the front office and re-submitted. There also the same error appeared, when the rectified Form 5 was uploaded from the front office help desk of ROC - Coimbatore.
A complaint was filed at the mca website, providing the above details and the Ticket No. generated is 1015734 Dt. 25/02/2013
Again on 10th April 2013, I visited the ROC, Coimbatore office and requested for their help, for which they advised me to lodge a complaint again. Accordingly I lodged a complaint again on 10.04.2013.
For the above complaint registered, the helpdesk, without going into the details of the complaint has given a very nasty reply, stating that as per the above circular, the form should have been resubmitted before 31.03.2013, while the complaint itself, the website did not accept the form on my many attempts. On 15th April, the helpdesk is stating that resubmission should have been done before 31st March 2013 without paying equal fees,( for your information the fees paid for filing Form 5 on 22.01.2013 was Rs. 1,51,065/=), whereas the complaint itself, is that due to the technical problems with the website, we could not resubmit the form. So without looking in to the contents of the complaint they are just sending a reply and stating that the issue has been resolved.
This is a great injustice to the Company and to myself as the fee paid is now lost as per the recent reply of the helpdesk.
Majority of the professionals are facing similar problems with the mca website and as a last resort, we have now approached the Hon'ble Lordships seeking justice from the highest judicial forum.

The Ministry web based compliance , submission of online documents are not working properly for more than 3 months. The reason being earlier web based support was given by Tata Consultancy Limited. Now it is entrusted to Infosys Limited . The present provider is not working properly for last more than 3 months.
There is total disruption in compliance web based working of Ministry of Corporate Affairs . All Professionals and public at large are suffering and representing to Hon. Ministry of Corporate Affairs but no action for more than 3 months. Your Lordships is requested and prayed to take appropriate action against Ministry of Corporate Affairs and Infosys Limited . This e mail may please be treated as Public Interest Litigation Petition and Oblige.\
